New rules on moving traffic offences…

 

New rules are set to come into force that will give local councils the authority to enforce moving traffic offences. 

These include yellow box and prohibited turn offences, as well as illegal U-turns and banned left and right turns.

However, some experts are calling on MPs to review the proposals ahead of their scheduled introduction on 1 June 2022.

The legislation will be introduced in June, giving local authorities the power to fine drivers in England and Wales.

Any councils that wish to push ahead with civil enforcement of moving traffic offences will be required to apply to the Secretary of State for an order to designate them as the enforcement authority in their area.

The statutory guidance for the changes is set to be published in March 2022, although this will depend on how quickly the legislative process is completed before then.

However, experts are calling for a soft-launch period where fines are temporarily suspended until offence hotspots are identified.

And even upon launch, some are asking for first-time warning letters to be issued rather than fines.

The changes form part of the government’s plan to create ‘great cycling and walking provisions’, which has also seen changes to the Highway Code introduced this year.
